1. Who gives this warranty

This warranty is given by Firefly Cove Pty Ltd (ABN 14 611 955 223, ACN 611 955 223) trading as Nordic Spa, of 34 Levanswell Road, Moorabbin VIC 3189. To make a claim or ask about this warranty, contact us at hello@nordicspa.com.au or on 03 6145 0600.

We supply this warranty with your order. Keep it with your proof of purchase.

2. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The benefits given by this warranty are in addition to other rights and remedies you have under a law in relation to the goods to which this warranty relates.

Nothing in this warranty excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law, or limits any remedy for the failure of a consumer guarantee. Where anything in this warranty is less favourable than those rights, your rights under the Australian Consumer Law apply. We do not rely on any limit of liability that the law does not allow for goods of a kind ordinarily acquired for personal, domestic or household use.

3. What is covered, and for how long

Timber structure: 5 years from the date of delivery, against defects in materials or workmanship, subject to the conditions in clause 4.

Electrical components: 1 year from the date of delivery. This covers heaters, controls, lighting and other electrical items, which are made by third parties and carry their manufacturer's standard term.

The warranty runs from delivery. We do not require you to register the product or return a card.

4. Conditions of cover

The timber warranty applies only where:

  • the building is erected on a foundation, and on ground, of suitable load-bearing capacity for the product and its intended use, kept level, adequately drained, and able to carry that load without settling or moving to an extent that damages the building, and assembled in accordance with the instructions supplied;
  • all exposed timber is sealed as soon as practicable after assembly, and in any case within 6 weeks, with a suitable exterior timber preservative or stain, applied as a primer or sealer coat and at least two topcoats;
  • the finish is maintained afterwards at the intervals recommended by the product you have used, and re-applied before the existing coating fails; and
  • the timber is kept protected against insects and timber pests, including by keeping the base dry, well drained and ventilated, and by taking reasonable steps against termites for your area.

A suitable foundation depends on your site, the ground conditions and how you intend to use the product, which only you, with your qualified builder or engineer, can assess. We supply the product, not the foundation: we do not design or specify it, so obtaining any engineering or building advice the site or intended use calls for is yours to arrange. Where the product holds water in use, such as a spa, hot tub or ice bath, the load to allow for is the product filled and in use, not the empty unit.

Keep your receipts for the treatment products you use, and for any pest treatment or inspection. We may ask for them.

Where your product is a spa, hot tub or ice bath, cover also depends on you maintaining balanced water chemistry, using only the chemicals we approve, keeping the unit covered when it is not in use, and not operating it above its rated temperature.

5. What this warranty does not cover

Timber is a natural material and it never stops moving. It expands and contracts with humidity and temperature for the life of the building. Surface checking and small splits that do not pass through, variation in colour and grain, knots, and resin exudation are characteristics of timber rather than defects, and they do not affect structural integrity.

Doors and windows will need adjusting. Timber components adapt to their new conditions in the first few weeks after assembly, and continue to move with the seasons afterwards, so periodic adjustment of doors and windows is normal maintenance rather than a fault.

This warranty also does not cover mould growth, intact knots that do not compromise stability, water entering during extreme rain, or damage to roof coverings in high wind.

Beyond the characteristics of timber, this warranty does not cover a problem to the extent it is caused by any of the following. In each case these are not defects in our materials or workmanship:

  • Accidental damage after delivery, such as impact, dropping or crushing, anything struck or dropped onto the product, and any damage in transit or handling that you or your carrier arrange after we have delivered.
  • Misuse, abuse, or use contrary to our written instructions, such as loading a roof, wall or shelf beyond its stated limit, running a sauna heater without the required rocks, exceeding a spa's rated bather load, or using the product for a purpose it was not designed for.
  • Failure to carry out the maintenance set out in clause 4 and in the manual, including failure to treat and re-coat the timber, or to maintain a spa's water and equipment.
  • Power surge, lightning or electrical-storm damage, or connection to a power supply that does not match the stated voltage and rating. Connect only to a compliant supply and consider fitting surge protection.
  • Incorrect or improper operation, or operation outside the parameters in the manual, including running a spa with water chemistry or temperature outside the recommended range, or not keeping the ventilation and clearances a sauna requires.
  • Insect, vermin and timber-pest attack, including termites, borers, and fungal decay or rot that arise from the conditions at your site, such as damp, poor drainage or a lack of airflow, rather than from a fault in the timber. Keeping the base dry and well drained and maintaining airflow is the best protection.
  • Unauthorised modification, alteration or addition, including structural changes, or cutting or drilling beyond what the manual allows, where that work has caused or contributed to the problem.
  • Repair, servicing or parts fitted by anyone we have not authorised, and the use of non-genuine parts or parts we did not supply, where that work or part has caused or contributed to the fault.
  • Incorrect installation or assembly carried out by you or your contractor contrary to our instructions, including failure to follow the assembly, fixing or clearance instructions.
  • Foundations and ground not of suitable capacity, meaning a foundation or ground conditions that were not of suitable capacity for the product and its intended use, or settlement, subsidence, tilting or movement of the foundation or the ground that is caused by the load of the product. Providing a foundation, and the ground beneath it, of suitable capacity for the product and its intended use is your responsibility, as is obtaining engineering or building advice where the site or intended use calls for it. For a spa, hot tub or ice bath, that capacity means the product filled with water and in use, not the empty unit.
  • Weather and natural events, including storm, flood, hail, fire, lightning, extreme heat or prolonged UV, frost, snow load beyond the rated limit, salt-spray corrosion at coastal sites without the specified finish, and naturally occurring ground movement, subsidence or heave of the site.
  • Consumables and finishes that you renew as the owner, including protective oils, stains and sealants, door and window seals, spa filter cartridges, sauna rocks, light globes and batteries.

6. What we will do, and who pays

Where you make a valid claim, we will, at our option, repair the defect or replace the defective part or product. For the timber structure, our remedy is to supply replacement material. For the first 12 months from delivery we also cover reasonable labour; after 12 months we cover replacement parts only. Any part we replace becomes our property, and we may use new or reconditioned parts of equivalent quality.

Because our products are large and delivered by freight, we will tell you at the time how a repair or replacement will be handled and who arranges and pays for any transport, removal, re-installation or call-out. Where the problem is a failure of a consumer guarantee under the Australian Consumer Law, and in particular a major failure or goods that cannot easily be returned, we bear the cost of collecting and returning the goods.

7. Conditions that apply to every claim

Residential use. This warranty covers residential use. It does not cover commercial use, meaning use where you charge others to use the product.

Notice. Contact us within 7 days of becoming aware of a defect, in writing and with photographs. If you do not, we may not cover damage that occurs after you became aware of it. This does not shorten any time you have to claim under the Australian Consumer Law.

Electrical work. All electrical connection and disconnection must be carried out by a licensed electrician, at your cost. We do not cover an electrical product connected otherwise, or damage arising from that work. This condition applies to the electrical cover only; it does not affect the timber warranty.

Proof of purchase. Please keep your proof of purchase. We may ask for it before we deal with a claim.

8. What this warranty is not

It is not the remedy for goods that arrive damaged, short or incomplete. Transit damage, a missing pallet and a missing component are dealt with under clause 10 (Inspection on delivery) of our Shipping policy, and must be reported within 3 days of delivery.

It is not a change of mind right. Returns are dealt with under clauses 7 and 8 (Change of mind after delivery) of our Return and refund policy.

9. Making a warranty claim

Email hello@nordicspa.com.au with your proof of purchase, your order number, a description of the problem and photographs. We will tell you what else we need and how it will be resolved.

10. General

We may change this warranty. A change does not affect a product we have already supplied; the version in effect at the time of your order applies to that order.

This warranty is governed by the law of Victoria, Australia.
